On 25 September 2025, the CEPU filed an application with the Fair Work Commission to alter its eligibility rule pursuant to s.158 of the Fair Work (Registered Organisations) Act 2009 (Cth) by inserting the following sub-rule 2.2B into rule 2 of the Union’s rules:
2.2B Without in any way limiting or being limited by the provisions of sub-rules 2.1 to 2.22, there shall be eligible for membership of the Union all employees of Endeavour Energy Network Management Pty Ltd (trading as Endeavour Energy), and any of its associated or successor entities.”
Employees of Endeavour Energy Network Management in NSW (trading as Endeavour Energy) have, historically, been members of the Union attached to the Electrical, Energy and Services Division’s NSW/ACT Divisional Branch. Until recently, the NSW/ACT Divisional Branch represented these members and its right to represent the industrial interests of these members was accepted and recognised by Endeavour Energy. However, Endeavour Energy has recently departed from its longstanding position contending for the first time that, properly construed, the Union’s eligibility rule does not permit the Union to enrol as members certain Endeavour Energy employees.
The purpose and effect of the proposed alteration is to remove any potential for ambiguity regarding the coverage of members of the union employed by Endeavour Energy by explicitly providing that the Union is able to enrol as members, employees of Endeavour.
The application to alter the eligibility rule can be found at this link.
